Wzór skargi został określony Rozporządzeniem Ministra Sprawiedliwości z dnia 23 listopada 2018 r. w sprawie określenia wzoru i sposobu udostępniania urzędowego formularza skargi na czynności komornika
Skargę na czynności komornika może złożyć dłużnik, wierzyciel, a także inna osoba, której prawa zostały przez czynności lub zaniechanie komornika naruszone bądź zagrożone – skarga przysługuje każdemu kto “odczuł” na sobie działania komornika związane z jego działalnością w danej sprawie.
Skargę na czynności komornika wnosi się do komornika sądowego, którego czynności lub zaniechania dotyczy skarga.
Skarga podlega opłacie w wysokości 50 zł. Opłata może zostać uiszczona przez naklejenie znaków opłaty sądowej lub dokonanie przelewu na konto sądu.
Można też wnieść skargę tymczasowo nieopłaconą – sąd wezwie do uiszczenia opłaty sądowej po przekazaniu mu skargi przez komornika.
Skargę wnosi się w terminie tygodniowym, najczęściej liczonym od dnia zawiadomienia o dokonaniu czynności.
Skarga nie przysługuje na zarządzenie komornika o wezwaniu do usunięcia braków pisma, na zawiadomienie o terminie czynności oraz na uiszczenie przez komornika podatku od towarów i usług.
